House Bill 72 (Transition Period Ending January 1, 2024)

Utah Department of Agriculture and Food (UDAF) will be taking over oversight of pharmacies during a “Transition Period” beginning on July 1, 2023, and ending on January 1, 2024, based on House Bill 72 – previously managed by the Department of Health and Human Services (DHHS). During this transitional period, the UDAF may request:

• The DHHS is to carry out the duties described in the pharmacy provisions.
• Technical assistance from the DHHS to carry out the pharmacy provisions.

UDAF may terminate or limit the scope of the DHHS’s power to carry out any duties described in the pharmacy provisions. If the UDAF requests the DHHS to carry out duties, they may make personnel available for carrying out the duties. Upon the request by the UDAF, the DHHS has the authority to carry out all of its duties during this transition within the scope of the request and/or if it’s related to pharmacy provisions.
