Colorado State Cannabis Laws

The Colorado State Cannabis Laws Certification Course is tailored to offer a detailed analysis of Colorado’s cannabis regulations, focusing on both recreational and medical marijuana. The course will encompass an overview of the legal framework established under the Colorado Revised Statutes (C.R.S.), particularly Title 44, Article 10, which consolidates regulations for medical and retail marijuana. This consolidation was mandated by legislation passed during the 2019 Legislative Session (SB19-224 Sunset Regulated Marijuana), effective from January 1, 2020.

Participants will learn about the specific stipulations for marijuana use in Colorado, including the legal age for purchase and possession, which is set at 21 years. The course will cover the possession limits, where adults over the age of 21 are allowed to buy and possess up to 1 ounce of marijuana at a time. Additionally, the course will address public consumption laws, emphasizing that using marijuana in any form (smoking, eating, or vaping) in public spaces is illegal. This includes areas such as sidewalks, parks, ski resorts, concert venues, and more. Moreover, the course will highlight that marijuana use on federal land remains illegal due to federal law overriding state legislations.

The certification will also delve into the point-of-sale regulations for marijuana in Colorado. These include the requirement for consumers to present a valid ID proving they are at least 21 years old, restrictions on minors entering retail marijuana stores, limited hours of operation for marijuana businesses, and specific packaging and labeling requirements to ensure safety and compliance.

Furthermore, the course will address workplace policies regarding drug testing for marijuana, implications for pregnant individuals, and the tax implications on retail marijuana sales, which include a 15% retail sales tax and a 15% excise tax on the wholesale price of retail marijuana. These taxes do not apply to medical marijuana.

This comprehensive certification aims to equip professionals with the necessary knowledge to navigate the legal landscape of cannabis in Colorado effectively, ensuring compliance and promoting responsible practices within the industry.
