West Virginia Cannabis Industry Certification

This training will deliver a basic understanding of operating a licensed medical cannabis business following the West Virginia Medical Cannabis Act. Every principal and employee working in a medical cannabis operation is required to take this training. We cover regulatory requirements that consist of the West Virginia provisions and regulations relevant to the industry’s responsibilities.

Additionally, the training will cover methods to recognize and report identified unauthorized activity, handling of medicinal cannabis, proper record keeping, prevention, and detection of diversion. Also, there are other considerations such as transportation, dispensing, emergency preparedness, chemical handling, many inventory control systems, storage, security, reporting requirements, and worker health and safety that you’ll find prevalent within the cannabis industry.

With this compliance training being required, it becomes extremely imperative to understand the underlying regulations to guide patients for lawful use and advise practitioners and organizations for authorized growing and selling of cannabis for medical purposes. This outlines regulations to control medicinal cannabis at every stage from cultivation to dispensing to patients and caregivers.

The laws allow for cannabis to be used for certified medical use by a West Virginia resident with a medical condition and this permits the use of cannabis for certified medical cannabis use. This industry certification will help to demarcate the legal use of medical cannabis by focusing specifically on growing, processing, selling, storage, transportation, prescription, testing, and pricing.

The training curriculum focuses on critical topics to uphold the safety and legality of medical cannabis operations. It includes methods to identify and report unauthorized activities, such as the diversion of medical cannabis for unlawful purposes and the falsification of identification cards.

Additionally, the training covers the proper handling of medical cannabis, emphasizing best practices for maintaining its integrity and ensuring accurate recordkeeping. The course is further tailored to meet any additional requirements established by the bureau, ensuring that it remains comprehensive and aligned with evolving regulations. This structured approach supports a secure and compliant environment for medical cannabis organizations across the state.

Certification Process

Continuing Education

West Virginia doesn't require continuing education expectations for principles & agents that requires annual medical cannabis training completion for staying updated on compliance changes.

All principals and employees of medical cannabis organizations in West Virginia
who either have direct contact with patients or caregivers or who physically
handle medical cannabis are required to complete this training. Employees must
complete the course within ninety (90) days of starting employment, while principals
must complete it before the organization’s initial operations as mandated by the Office of Medical Cannabis.

The training includes methods to recognize and report unauthorized activity,
such as diversion of medical cannabis and falsification of identification cards,
proper handling of medical cannabis, recordkeeping requirements, and any other
topics specified by the bureau in the Medical Cannabis Act.

This training ensures that all personnel are equipped with the knowledge to
operate responsibly, maintain compliance with state laws, and uphold the
integrity of state’s medical cannabis program regulated by the West Virginia Office of Medical Cannabis.

The Medical Cannabis Act defines Medical Cannabis as cannabis for certified medical use by a West Virginia resident with a serious medical condition.

  • Pill
  • Oil
  • Topical forms, including gels, cream or ointments
  • A form medically appropriate for administration by vaporization or nebulization, excluding dry leaf or plant form unless dry leaf or plants forms become acceptable under rules adopted by the Bureau for Public Health
  • Tincture
  • Liquid
  • Dermal Patch

The statute defines a “serious medical condition” as any one of the following:

  • Cancer
  • Position status for human immunodeficiency virus or acquired immune deficiency syndrome
  • Amyotrophic lateral sclerosis
  • Parkinson’s disease
  • Multiple sclerosis
  • Damage to the nervous tissue of the spinal cord with objective neurological indication of intractable spasticity
  • Epilepsy
  • Neuropathies
  • Huntington’s disease
  • Crohn’s disease
  • Post-traumatic stress disorder
  • Intractable seizures
  • Sickle cell anemia
  • Severe chronic or intractable pain of neuropathic origin or severe chronic or intractable pain
  • Terminal illness that is defined as a medical prognosis of life expectancy of approximately one year or less if the illness runs its normal course

The Act provides for funding for research institutions to study the impact of medical cannabis on the treatment and symptom management of serious medical conditions. The advisory committee will review these research findings and make recommendations to the legislature for changes to the Act. In addition to funding for implementation and research, the Act further provides revenue to the Fight Substance Abuse Fund; the Division of Justice and Community Services, for grants to local law enforcement agencies for training, drug diversion, and other programs focused on crime and addiction; and a fund to be used for law enforcement professional training and professional development programs.

The Medical Cannabis Act establishes the Medical Cannabis Advisory Board within the Bureau for Public Health. The Board has the following duties:

  • Examine and analyze the statutory and regulatory law relating to medical cannabis within this state.
  • Examine and analyze the law and events in other states and the nation with respect to medical cannabis.
  • Accept and review written comments from individuals and organizations about medical cannabis.
  • Issue a written report to the Governor, the Senate, and the House of Delegates that includes recommendations on:
    • Whether there should be changes to the types of medical professionals who can issue certifications to patients.
    • Whether to change, add, or reduce the types of medical conditions which qualify as serious medical conditions.
    • Whether to change the form of medical cannabis permitted.
    • Whether to change, add, or reduce the number of growers, processors, or dispensaries.
    • How to ensure affordable patient access to medical cannabis.
    • Whether to permit medical cannabis to be dispensed in dry leaf or plant form, for administration by vaporization.

The Board consists of the following members:

  • The Commissioner of the Bureau for Public Health or a designee
  • The Superintendent of the West Virginia State Police or a designee
  • Four physicians licensed to practice in the state, appointed by the State Medical Association, with one each from the following areas of medicine:
    • Family Practice/Neurology/General Practitioner
    • Pain Management
    • Oncologist/Palliative Care
    • Psychiatrist
  • Two physicians who are licensed pursuant to §30-14-1 et seq. of this code, appointed by the West Virginia Osteopathic Association
  • One pharmacist designated by the Board of Pharmacy
  • One pharmacologist appointed by the Governor
  • One horticulturist designated by the West Virginia Commissioner of Agriculture
  • One member designated by the West Virginia Association of Alcoholism and Drug Counselors
  • An attorney licensed in West Virginia who is knowledgeable about medical cannabis laws
  • One member appointed by the West Virginia Prosecuting Attorneys Institute
  • One member appointed by the Governor who shall be a patient, a family or household member of a patient, or a patient advocate

After receiving the report of the Board, at the discretion of the Commissioner, the Bureau for Public Health may incorporate the recommendations into proposed legislative rules for consideration by the West Virginia Legislature. The Commissioner is required to issue notice in the State Register within twelve months of receiving the Board’s report. The notice will include recommendations of the Board and state the specific reasons for the Commissioner’s decisions on each of the Board’s recommendations.

Members are will not receive compensation, but will receive reasonable reimbursement for travel, hotel and other necessary expenses incurred in the performance of the duties of the member in accordance with state rules.

Members appointed by the Governor have terms of four years or until a successor has been appointed and qualified, but no longer than six months beyond the four-year period. The Commissioner, or designee, of the Bureau for Public Health serves as chair of the Board. A quorum, for purposes of organizing, conducting business and fulfilling Board duties, is constituted as a majority of the Board members in attendance. A member who fails to attend three consecutive meetings shall be deemed vacant unless excused by the Commissioner for good cause. Board meetings may be attended electronically by board members.
