South Dakota

\”South Dakota has had an interesting path in the world of cannabis legalization. In 2020, South Dakota became the first state in the U.S. where voters approved both medical and recreational cannabis on the same ballot. However, the journey has not been smooth. While voters passed Measure 26 to legalize medical cannabis and Amendment A to legalize recreational cannabis, Amendment A faced legal challenges. In 2021, the South Dakota Supreme Court overturned the recreational cannabis initiative, citing procedural issues with the amendment’s language.
Despite this setback, the state’s medical cannabis program, enacted in 2021, remains in place. Patients with qualifying conditions can purchase cannabis from licensed dispensaries and possess up to 3 ounces of cannabis. The state continues to evaluate the future of recreational cannabis, but for now, advocates remain focused on expanding the medical program. As neighboring states move forward with broader legalization, South Dakota is likely to remain a battleground for cannabis reform in the years to come.\”
